1. About these terms and conditions

These are the terms and conditions (Terms) which govern your use of any of the following:

1. the Keystart website (Site), located at: https://www.keystart.com.au/

2. the following additional websites:

3. the Keystart mobile application (Keystart App)

(collectively Electronic Platforms).

Our Electronic Platforms are operated by Keystart Loans Limited (ABN 27 009 427 034) (Keystart, we/us/our). Where you are a customer of the Country Housing Authority (ABN 76 667 185 896) (CHA), we operate as agents for CHA. CHA customers only have access to the Site.

Together with our Privacy Policy and any other policies published on our Site from time to time, these Terms form a binding contractual agreement between you, the user of the Electronic Platforms, and us.

For that reason, these Terms are important and you should ensure that you read them carefully and Contact Us with any questions before you use the Electronic Platforms.

Your use of the Electronic Platforms signifies and confirms your acknowledgement that you have had sufficient chance to read and understand the Terms, and that you agree to be bound by the Terms. If you do not agree to the Terms, you must not use the Electronic Platforms.

We reserve the right to change the Terms from time to time at our sole discretion. You must periodically check the Terms to see if any of the changes affect you or your circumstances. By your continued use of the Electronic Platforms, you are deemed to have agreed to any such changes. If you do not agree to any change, you must not use the Electronic Platforms.

You represent and warrant to us that:

  • you have legal capacity to enter into these Terms;
  • you have abided by the Terms;
  • you will only use the Electronic Platforms for you personally or for other persons on whose behalf you are legally authorised to act;
  • where you use the Electronic Platforms for another person, you are authorised to provide their information to us and have informed them of these Terms; and
  • all information you supply to us are true, accurate and up to date.

2. Our Services

Our Electronic Platforms are provided for use by Western Australian residents only, and the products and services described in the Electronic Platforms are not directed at anyone outside Western Australia. The information is prepared in accordance with the laws of Western Australia and the Commonwealth of Australia. The Electronic Platforms may not comply with the laws of any other country. However, you are bound by these Terms even if you reside at any time outside of Western Australia.

For the avoidance of doubt, any information displayed, provided or accessible on the Electronic Platforms (Content) is for informational purposes only and does not constitute an offer by us to provide credit. If you wish for us to consider offering you credit, you must complete an application.

Functionalities of the Keystart App and the Portals

Through the Keystart App and the Portals, we enable you to set up and manage your account with us by offering the following functionalities.

Register and login

  • registration and onboarding;
  • authentication;
  • password reset;
  • contact detail update; and
  • Keystart App settings (eg notification, password, PIN, biometrics) (only available on the Keystart App).

Manage existing loan

  • account overview;
  • loan balance;
  • current interest rate; and
  • access to article content on various topics.

Correspondence

  • statements, direct debit letters and interest rate change notices; and
  • transaction listings.

Repayments

  • additional repayments set up and management; and
  • existing direct debit payment management.

Equity Estimator (only available on the Keystart App)

  • estimated equity movement and home value.

CoreLogic data in Equity Estimator

The following additional terms and conditions apply to the use of Equity Estimator Service, which is available both on the Keystart app and will also be available when you contact Keystart directly.

The Equity Estimator Service available contains data, analytics, statistics, results, and other information licensed to us by RP Data Pty Ltd trading as CoreLogic Asia Pacific (CoreLogic Data). The CoreLogic Data provided is of a general nature and should not be construed as specific advice or relied upon in lieu of appropriate professional advice. While CoreLogic uses commercially reasonable efforts to ensure the CoreLogic Data is current, CoreLogic does not warrant the accuracy, currency, or completeness of the CoreLogic Data and to the full extent permitted by law excludes all loss or damage howsoever arising (including through negligence) in connection with the CoreLogic Data.

In the Keystart App, Keystart reproduces materials and content owned or licenced by RP Data Pty Ltd trading as CoreLogic Asia Pacific (CoreLogic) and may include data, statistics, estimates, indices, photographs, maps, tools, calculators (including their outputs), commentary, reports and other information (CoreLogic Data).

Automated valuation model

An automated valuation model estimate (AVM Estimate) is a statistically derived estimate of the value of the subject property. An AVM Estimate is generated (i) by a computer-driven mathematical model in reliance on available data; (ii) without the physical inspection of the subject property; (iii) without taking into account any market conditions (including building, planning, or economic), and/or (iv) without identifying observable features or risks (including adverse environmental issues, state of repair, improvements, renovations, aesthetics, views or aspect) which may, together or separately, affect the value.

An AVM Estimate is current only at the date of publication or supply. An AVM Estimate must not be relied upon as a professional valuation or an accurate representation of the market value of the subject property as determined by a valuer. CoreLogic expressly excludes any warranties and representations that an AVM Estimate is an accurate representation as to the market value of the subject property.

Confident indicators

High: High confidence is typically a result of a greater number of available comparable properties and/or a lesser degree of variability between the subject and comparable properties and/or high availability of comparable property data in the area.

Medium: Medium confidence typically a result of a medium degree of available comparable properties and variability between the subject and comparable properties in the area and/or medium availability of comparable property data in the area.

Low: Low confidence typically a results of fewer available comparable properties and/or a high degree of variability between the subject and comparable properties in the area and/or low availability of comparable property data in the area. This AVM is not reliable and should only be used with caution.

To the full extent permitted by law, CoreLogic excludes all liability for any loss or damage howsoever arising or suffered by the recipient, whether as a result of the recipient's reliance on the accuracy of an AVM Estimate or otherwise arising in connection with an AVM Estimate.

3. Your use of the Electronic Platforms

You may use the Electronic Platforms for your own personal, non-commercial use.

You must not:

  • misuse the Electronic Platforms and/or the Content, including by spamming or introducing viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful or which restricts anyone else’s enjoyment of the Electronic Platforms; or
  • attempt to gain unauthorised access to the Electronic Platforms, or any tangible, intangible infrastructure that supports the operation of the Electronic Platforms.

4. Collection and use of information

We may collect personal information from you directly or via your use of our Electronic Platforms in accordance with our Privacy Policy. We will only collect personal information that is reasonably necessary for, or directly related to, our functions or activities.

When you provide us with any information, we may retain, use or disclose the information in accordance with our Privacy Policy.

On the Site, where you can commence an enquiry online, you may suspend and save the enquiry so you can complete and send the enquiry at a later time. If you suspend or save your enquiry, the information that you have entered will be retained in our systems so that you may recover the information when you resume your enquiry. Online enquiries that have been suspended or saved may be viewed by us.

Information from third parties

Our Electronic Platforms may contain links to the websites and content operated by third party providers of goods and services or businesses (Third Party Websites). If you have accessed Third Party Websites through our Electronic Platforms, and if those third parties collect information about you, we may also collect or have access to that information as part of our arrangements with those third parties.

Where you access a Third Party Website from our Electronic Platforms, cookie information, information about your preferences or other information you have provided about yourself may be shared between us and the third party.

Advertising and tracking

When you view our advertisements on a Third Party Website, the advertising company may use ‘cookies’ and in some cases ‘web beacons’ to collect information such as:

  • the server your computer is logged onto;
  • your browser type;
  • the date and time of your visit; and
  • the performance of their marketing efforts.

When you access our website after viewing one of our advertisements on a Third Party Website, the advertising company collects information on how you utilise our website (eg which pages you view) and whether you complete an online enquiry.

Cookies

We use ‘cookies’ to provide you with better and more customised service and with a more effective website.

A ‘cookie’ is a small text file placed on your computer by our web page server. A cookie can later be retrieved by our webpage servers. Cookies are frequently used on websites, and you can choose if and how a cookie will be accepted by configuring your preferences and options in your internet browser.

We use cookies for different purposes such as:

  • to allocate a unique number to your internet browsers;
  • to customise our website for you;
  • for statistical purposes;
  • to identify if you have accessed a Third Party Website; and
  • for security purposes.

IP addresses

Your IP address is the identifier for your computer when you are using the internet.

It may be necessary for us to collect your IP address for your interaction with various parts of our website.

5. Third Party Websites

We are not responsible for, nor do we endorse in any way such Third Party Websites or their content. If you decide to access any of the Third Party Websites linked to the Electronic Platforms, you do so entirely at your own risk. We have no control over the content of those other websites, plugins, applications and content and we are not responsible for them.

You may link to our Site, provided you do so in a way that is fair and legal and does not damage our reputation or take unfair advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part unless we have agreed to that.

6. Third Party Advertisement

The Electronic Platforms may contain information and advertising from third-party businesses including Third Party Websites. You consent to viewing this information as part of your use of the Electronic Platforms, and you may choose to interact with such Third Party Websites. Any information provided to us as part of your interaction with the third party advertisement is subject to the terms of our Privacy Policy

We are not responsible for any information transmitted by third parties or liable for any reliance you make upon the information or statements conveyed by third parties (or in relation to your dealings with third parties), nor are we responsible for the accuracy of any advertisements contained on the Electronic Platforms.

7. Registration for the Keystart App and the Portals

To access the full suite of Services offered on the Keystart App and the Portals, you must register for the use of the Keystart App and the Portals. The registration process may require a verification process which involves us sending you a verification code via an SMS text message or an email. You must not share this code with anyone else. The verification process will enable you to set up login credentials. You are responsible for keeping your login credentials secret. As soon as you know or have reason to suspect that your login credentials are no longer secret, or that your access to any of our Service is being abused, you must notify us immediately and take all necessary steps to prevent unauthorised access.

The Keystart App and the Portals may not be available for registration for all Keystart Customers.

You must not:

  • provide information during registration for use of the Keystart App or the Portals that is not accurate, complete or up-to-date;
  • register use of the Keystart App or the Portals for another natural person;
  • share your login credentials or in any other way provide access to the Keystart App on your device or the Portals to another person or legal entity; or
  • impersonate another person or use another person’s name or account details without permission.

You indemnify us for any loss or damage you suffer as a result of unauthorised access to the Keystart App on your mobile device or the Portals, or any breach by you of this clause. You are solely responsible for the use of the Keystart App on your mobile device or the Portals, irrespective of who is utilising it, whether with or without your permission.

8. Intellectual Property Rights

We are the owner or licensee of all intellectual property rights in the Electronic Platforms and the Content. Subject to these Terms, we grant you a limited, temporary, revocable and non-exclusive licence to access, browse and use the Electronic Platforms in accordance with the Terms.

The Content including the trademarks, names, logos, sounds, images, graphics, text, software, software code, tools, results derived from the use of software and tools, interfaces, website structure, copyright works and materials displayed on it, its layout and design (Keystart Intellectual Property Rights) are protected by copyright, trademark and other intellectual property laws unless expressly indicated otherwise on the Electronic Platforms. All rights, title and interest in and to the Content, including the Keystart Intellectual Property Rights, are owned, licensed or controlled by Keystart or the party credited as the provider of the Content. You must not reproduce, copy, imitate or otherwise use any of the Content, in whole or in part, in a manner that is reasonably likely to infringe the Keystart Intellectual Property Rights without prior written permission from us or our licensors.

9. Limitation of Liability

These Terms are to be read subject to any legislation which prohibits or restricts the exclusion, restriction or modification of any implied warranties, conditions, guarantees or obligations, including under the Australian Consumer Law (ACL). If such legislation applies, to the extent possible, we limit our liability in respect of any claim to, at our discretion:
  • the supply of the Services again; or
  • the payment of the cost of having the Services supplied again.
Except as otherwise provided for above and to the extent permitted by law, we
  • make no representations or warranties (whether express or implied) other than those expressly set out in these Terms; and
  • exclude all liability in respect of loss of data, conduct or activities by any user, interruption of business, loss of profits, goodwill, bargain or opportunity, loss of anticipated savings or any consequential, indirect or incidental damages resulting from your access to, or use of, or inability to use, the Electronic Platforms or any Content, or in any manner relating to our performance or non-performance of the Services, whether based on warranty, contract, tort, negligence, in equity or any other legal theory, and whether or not we knew or should have known of the possibility of such damage to business interruption of any type, whether in tort, contract or otherwise.
You agree to indemnify us and CHA, their related parties and their respective officers, agents and employees for any loss, damage, cost or expense suffered or incurred as a result of, or in connection with, your use of the Electronic Platforms, including any breach by you of these Terms.

10. Suspension and Termination of use of the Keystart App and Portals

Keystart may suspend or terminate, at our sole discretion, your use of the Keystart App or the Portals or your access to any functionality of the Keystart App or the Portals, at any time where we consider it reasonable in protecting us, to reasonably protect you, if the Keystart App or the Portals are no longer appropriate for the management of your loan account or as permitted by Law. For example, we may do so where we consider such suspension or termination a reasonable step to protect us or you from suffering financial loss and/or to prevent fraud.

The Keystart App and the Portals will no longer be available to you when you cease to be a customer of Keystart.

The Keystart App and the Portals may be unavailable from time to time and temporary service interruptions may occur. If this occurs, you can still contact Keystart directly at Contact Us to manage your loan account.

11. Minimum operating system requirements

Site and Portals

The Site and Portals work best on the following browsers:

  • Microsoft Edge: Latest two versions.
  • Firefox: Latest two versions.
  • Chrome: Latest two versions.
  • Safari: Latest two versions.

Keystart App

  • The Keystart App is only available on Android and iOS devices.
  • The minimum operating system requirements are iOS 13, Android 10 or higher.
  • The Keystart App is designed to run on a mobile phone device and not a tablet device. The Keystart App may not have full functionality on a tablet device.

12. General

You must not transfer, assign, sub-licence or otherwise deal in any other way with any of your rights under these Terms. We may transfer, assign or novate our rights and obligations under these Terms at any time without your consent.

If a Court finds part of these Terms invalid or unenforceable, it is to be read down or severed to the extent necessary without affecting the validity or enforceability of the remaining provisions.

The parties agree that the Terms shall be accepted electronically and the agreement to the Terms is formed and validly entered into electronically.

Communications and notices will be sent to you as per your communication preferences, to the extent permitted by Law. These preferences can be updated on the Keystart App, Client Portal or by contacting us directly. It is your responsibility to ensure your contact details are up to date.

These Terms are governed by the laws of Western Australia and each party submits to the non-exclusive jurisdiction of the courts of Western Australia.
